Terms of Service

Draft — pending legal review

This document is a working draft and has not yet been reviewed by a lawyer. Text in [SQUARE BRACKETS] is a placeholder that will be completed before Altanik accepts paid customers.

These Terms of Service (“Terms”) govern your access to and use of Altanik, including the web application, the browser extension and client share links (together, the “Service”). Please read them carefully. By creating an account or using the Service you agree to these Terms.

1. Who we are

The Service is provided by [COMPANY NAME — JDG registered name], a sole proprietorship (jednoosobowa działalność gospodarcza) registered in the Polish Central Register and Information on Economic Activity (CEIDG), NIP [NIP], REGON [REGON], with its registered address at [REGISTERED ADDRESS], Poland (“Altanik”, “we”, “us”).

We are an active VAT payer registered for intra-EU transactions (EU VAT number PL[NIP]). You can contact us at [CONTACT EMAIL].

2. A service for professionals

Altanik is built for interior designers, architects, home stagers and their studios. You confirm that you use the Service for purposes related to your trade, business or profession. If you accept these Terms on behalf of a studio or company, you confirm that you are authorised to bind it, and “Customer” or “you” then means that organisation.

Nothing in these Terms limits rights that you cannot waive under mandatory law, including the protections Polish law grants to sole traders who conclude contracts not of a professional nature for them.

3. Accounts, seats and fair use

You must give accurate account information, keep your credentials confidential and tell us promptly about any unauthorised use. We recommend enabling two-factor authentication. You are responsible for the team members, collaborators and guests you invite and for what they do in your workspace.

Plans that include unlimited seats are subject to fair use: seats are for your own staff and the collaborators you regularly work with. They may not be resold, shared between unrelated businesses or used to run automated workloads.

4. Plans, prices and payment

Altanik offers a free plan and paid subscription plans. The features and limits of each plan are shown on our pricing page at the time you subscribe.

Our order process is conducted by our online reseller Paddle.com Market Ltd (“Paddle”). Paddle is the merchant of record for all our orders: it is the seller of the subscription to you, it processes your payment, issues your invoice and handles sales tax, billing questions and refunds. Paddle’s own buyer terms apply to your purchase.

Prices are set in euros (EUR) and shown net of VAT; VAT or other sales taxes are added where applicable. Any local-currency amount is an estimate only — you are billed in euros. If you enter a valid VAT ID at checkout, Paddle may apply the reverse-charge mechanism and charge no VAT.

Subscriptions renew automatically at the end of each monthly or annual billing period until cancelled. You can cancel at any time in the customer portal; cancellation takes effect at the end of the current billing period. We will give you at least 30 days’ notice before a price change applies to your next renewal.

If a payment fails and Paddle cannot collect it after its retries, your workspace is moved to the free plan. We never delete your data because of a failed payment: content above the free plan’s limits becomes read-only until you upgrade again.

5. Refunds

You can get a full refund of your first payment within 14 days, no questions asked. Details are in our Refund Policy.

6. Your content and your clients’ data

You keep all rights in the content you add to Altanik — lists, products, images, files, notes, messages and client details. You grant us a limited licence to host, copy, process, display and transmit that content only as needed to provide the Service to you and to the people you share it with.

For personal data of your clients and other people that you add to the Service, you are the controller and we act as your processor. Our Data Processing Agreement (DPA) forms part of these Terms. You are responsible for having a lawful basis for the data you upload and for informing the people concerned.

We never sell or mine your or your clients’ data, and we do not use your content to train AI models.

7. Acceptable use

You agree not to:

  • upload unlawful content or content that infringes anyone’s intellectual-property or privacy rights;
  • upload malware or attempt to probe, bypass or break the Service’s security, access controls or plan limits;
  • access other customers’ data or interfere with the Service’s availability for others;
  • use share links or notifications to send spam or unsolicited marketing;
  • reverse engineer the Service except to the extent mandatory law allows;
  • use the Service in breach of applicable law, including sanctions and export-control law.

8. Browser extension and on-device AI

The Altanik browser extension extracts product details on your own device, using structured data on the page and an AI model that runs locally in your browser. Pages you browse are not sent to us; only the items you choose to save are sent to your account.

Fields filled in by AI are labelled as AI-generated. Automated extraction can be wrong: check prices, dimensions, availability and other details before you share them with clients or place orders. Estimates and totals in Altanik are tools to help you — you remain responsible for the quotes and advice you give your clients.

9. Availability, changes and support

We work to keep the Service available and secure, but we do not guarantee uninterrupted availability and we may carry out maintenance. Unless agreed in writing, no service-level commitment applies.

We continuously improve the Service and may add, change or remove features. We will not materially reduce the core functionality of a paid plan during a billing period you have already paid for. Support is provided by email at [CONTACT EMAIL].

10. Our intellectual property

The Service, including its software, design and branding, belongs to us or our licensors. These Terms give you a non-exclusive, non-transferable right to use the Service during your subscription. If you send us feedback, we may use it without obligation to you.

11. Term, termination and data export

These Terms apply for as long as you have an account. You can delete your account at any time in Settings. We may suspend or terminate your access for a material breach of these Terms, for non-payment, or where required by law; where reasonable, we will warn you first and give you time to fix the problem.

You can export your data at any time (JSON, Excel and a ZIP of your files). When your account is deleted, your data is removed from our live systems and purged from backups within our 30-day backup retention period, unless the law requires us to keep it longer.

12. Warranties and limitation of liability

To the extent permitted by law, the Service is provided “as is” and “as available”, without warranties of fitness for a particular purpose.

To the extent permitted by law, we are not liable for lost profits, lost revenue or indirect damage, and our total liability arising out of or in connection with the Service is limited to the fees you paid for the Service in the 12 months before the event giving rise to the claim [LIABILITY CAP — to be confirmed by counsel]. These limits do not apply to damage caused intentionally or to any liability that cannot be limited under applicable law.

13. Governing law and disputes

These Terms are governed by the law of the Republic of Poland, excluding the UN Convention on Contracts for the International Sale of Goods. Disputes will be resolved by the common court having jurisdiction over our registered office [COMPETENT COURT — city], unless mandatory law provides otherwise.

14. Changes to these Terms

We may update these Terms. We will notify you by email or in the app at least 30 days before a material change takes effect. If you do not agree, you can cancel before the change applies; continuing to use the Service afterwards means you accept the updated Terms.
